What is estate administration?

Estate administration is the legal process of:

  • managing and settling a deceased person’s affairs, including paying off debts and complying with final taxation obligations; and
  • distributing the assets, property and belongings in accordance with the Will (if there is one) or pursuant to the law. 

The administration of an estate may be done with or without a Will:

  • if there is a Will, the executor named in the Will is responsible for administering the estate; or
  • if there is no Will, someone (usually a family member, but it can be an independent person) may apply to the court for permission to manage the estate. This is known as “letters of administration”.
