What is an Enduring Power of Attorney?
An Enduring Power of Attorney is a legal document that allows someone you trust to make decisions on your behalf, particularly if you lose capacity and are unable to make or communicate your decisions. It allows you to appoint a trusted person (your attorney) to manage things on your behalf including your financial decisions, health decisions and personal decisions.
Having an Enduring Power of Attorney is important as it gives you control over who makes important decisions on your behalf. It can also help to avoid legal issues (and subsequent court applications) later on in circumstances where you do not have capacity and there is nobody in place to make your important decisions.
